These Consumer Terms and Conditions ("Terms") govern the use of products and services provided by City Optics Pty Ltd ("City Optics," "we," "us," or "our") to you, the consumer. By purchasing products or using services from us, you agree to be bound by these Terms.

  1. Products and Services

1.1. Product Description: We make every effort to ensure that product descriptions and specifications provided on our website, in-store, or through other channels are accurate. However, we do not warrant that such descriptions or specifications are error-free, and we reserve the right to correct any errors or inaccuracies.

1.2. Eye Testing and Prescription Eyewear: We offer comprehensive eye testing services at our store conducted by qualified optometrists. Prescription eyewear, including glasses and contact lenses, can be ordered following an eye examination conducted by our optometrists. Customers may also provide their own valid prescription provided by a licensed optometrist or ophthalmologist. We rely on the accuracy of prescriptions provided by customers or obtained through our eye testing services.

1.3. Fitting and Adjustments: We offer fitting and adjustment services for eyewear purchased from us to ensure proper fit and comfort. These services are provided free of charge within a reasonable timeframe after purchase.

  1. Ordering and Payment

2.1. Order Placement:

Orders for products or services may be placed through our website, in-store, or via other authorised channels. By placing an order, you agree to pay the specified price for the selected products or services.

2.2. Price and Payment:

Prices for products and services are displayed in Australian dollars (AUD) and are inclusive of Goods and Services Tax (GST), unless otherwise stated. We offer various payment methods to accommodate your preferences:

  • Cash: Available for in-store purchases. Please have the correct amount as change may be limited.
  • Credit and Debit Cards: We accept major cards, including Visa, MasterCard, and American Express, for both in-store and online purchases. Secure processing of card information is guaranteed.
  • Afterpay: Available for both in-store and online purchases, allowing you to buy now and pay later in four equal instalments.
  • Bank Transfers: For online purchases, select bank transfer at checkout and follow the instructions provided. Note: Items will only be dispatched once payment has cleared.
  • Gift Cards and Vouchers: Redeemable for in-store purchases only, applicable towards the total purchase price, including taxes and shipping.

2.3. Order Confirmation and Receipts:

Upon receipt of your order, we will send you an order confirmation via email or another communication channel. This confirmation is an acknowledgment of your order but does not constitute acceptance until the products or services are dispatched or provided. Paper receipts are available for in-store purchases.

2.4. Payment Security:

We prioritize the security of your transactions. All online payments are processed through secure encryption to protect your information.

3.1. Delivery Options: We offer delivery services for orders placed through our website or other authorised channels. Delivery times and costs may vary depending on your location and the selected delivery method.

3.2. Delivery Delays: While we make every effort to deliver orders promptly, we do not guarantee delivery times and are not liable for delays caused by circumstances beyond our control, including but not limited to courier delays, inclement weather, or public holidays.

  1. In-Store Returns, Exchanges, and Refunds

4.1. Return Policy: We welcome returns within 7 days for most products, except prescription eyewear and personalised items. To qualify for a return, items must be in their original, unworn condition and accompanied by proof of purchase.

4.2. Exchange-Only Policy: Instead of refunds, we are pleased to offer an exchange option for products returned under our 14-day policy. This ensures you find the right product to meet your needs, even if your initial choice wasn't perfect.

  • Eligibility for Exchange: Products qualifying for return as described in 4.1 are eligible for exchange, provided they maintain their original condition, are unworn, and come with proof of purchase. The item you exchange for must be of equal or greater value than your original purchase.
  • Process for Exchanging Products: Begin the exchange process by bringing the item(s) you wish to exchange, along with the original receipt, to our store. Our staff will guide you through selecting a new product and facilitate the in-store exchange.
  • Value Difference: Should the chosen replacement item have a greater value than the original purchase, you will need to cover the price difference at the time of exchange. No refunds will be provided should the replacement item have a lesser value.
  • Exclusions: Please note, that exchanges are not available for items purchased on sale, for change-of-mind returns, or for personalised items customised specifically for you.

4.3. Refunds: Our policy primarily offers exchanges to ensure customer satisfaction. Refunds will only be issued in compliance with the Australian Consumer Law, such as in cases where the products are majorly defective, not as described, or fail to perform as intended.

4.4. Prescription Eyewear: Due to their custom nature, prescription eyewear, including glasses and contact lenses, is generally exempt from returns and exchanges unless a defect in materials or workmanship is identified. We encourage you to contact us to explore your options under these circumstances.

  1. Warranty and Liability

5.1. Product Warranty: We provide a 3-month optical warranty specifically covering prescription issues for lenses. This warranty applies to defects related to the prescription, such as an incorrect prescription. Frames and lenses are covered by a 12-month manufacturer warranty against defects in materials and workmanship. Please note that damaging frames and lenses yourself, such as through accidental damage or misuse, do not constitute grounds for warranty coverage. 

5.2. Multifocal Lens Adaptation: Patients who experience difficulty adapting to multifocal lenses may exchange them for bifocals or two pairs of single-vision lenses within 3 months of purchase. There will be no reimbursement for the price difference between multifocal and bifocal/single-vision lenses. 

5.3. Deposits for Prescription Jobs: For all prescription jobs, we require a deposit from customers who are not paying in full at the time of purchase. Deposits are non-refundable for completed jobs or if not collected within 6 months of purchase.

5.4. Limitation of Liability: To the extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising out of or related to the use or inability to use our products or services.

6.1. Website Terms of Use: Your use of our website and online services is subject to our website terms of use, available https://www.cityoptics.com.au . By using our website, you agree to be bound by these terms.

6.2. Product Availability: While we make every effort to ensure the availability of products displayed on our website, we cannot guarantee that all products will be in stock at all times. We reserve the right to discontinue or modify products without prior notice.

6.3. Prescription Verification: Prescription contact lenses may only be purchased with a valid prescription provided by a licensed optometrist or ophthalmologist. By placing an order for prescription contact lenses, you confirm that you have a valid prescription and agree to provide it upon request.

6.4. Shipping and Handling: Shipping and handling fees may apply to online orders. Delivery times and costs are provided at checkout and may vary depending on your location and the selected shipping method.3. Delivery and Collection

6.4.1 Delivery Services: City Optics Pty Ltd is committed to delivering your purchases in a timely and efficient manner. Our delivery services are designed to provide you with a seamless shopping experience from our website directly to your doorstep.

6.4.2 Domestic Shipping:

  • Shipping Charges: A flat rate of $9.99 applies to orders under $100. We are pleased to offer free shipping on orders of $100 and above.
  • Delivery Carrier: We partner with Australia Post for all domestic deliveries, ensuring reliable and trackable shipping throughout Australia.
  • Estimated Delivery Times: Our standard delivery timeframe is 3 - 5 business days from the date of dispatch. You will receive an email with shipping and tracking details to follow the progress of your delivery.

6.4.3 Exclusions:

  • International Shipping: Currently, City Optics does not offer international shipping services. All orders are shipped within Australia only.
  • Product Availability: We do not sell prescription glasses on our website. Our available products include sunglasses and contact lenses, subject to stock availability and updates.

6.4.4 Order Processing Times:

  • Sunglasses: Estimated at 4 - 5 business days for processing.
  • Contact Lenses: Estimated at 4 - 5 business days for processing. Please note that these times are estimates and commence from the order placement date.

6.4.5 Customer Responsibility:

Accuracy in shipping details is essential to ensure prompt delivery. In case of any delivery issues or if an item goes into back-order, our customer service team will communicate with you to provide updates and solutions.

6.4.6 Security and Order Verification:

City Optics reserves the right to verify order details and withhold dispatch if discrepancies or suspicious information is found, ensuring the security of transactions and compliance with our policies. In cases where delivered parcels do not match order specifications, we will undertake verification procedures for resolution.

6.5. Online Purchases - Returns and Exchanges

6.5.1 Return Process for Online Purchases: Returns are accepted within 30 calendar days from the delivery date of your order, assuming the product remains in its original condition, with all tags and stickers attached, and contained within its initial packaging. To initiate a return, please follow these steps:

6.5.2 Undeliverable Orders: In instances where an order is undeliverable and returned to us, our team will make an effort to contact you to confirm your details and arrange for redelivery. If we do not receive a response within 30 days of contact, a refund will be processed to the original payment method.

6.5.3 Refund Timing: Please allow 10 – 30 business days for the returns and refund process to be completed once we receive the returned item(s).

6.5.4 Refund Method: Refunds will be issued to the original payment method used at the time of purchase.

6.5.5 Risk of Loss: The sender/customer bears the risk of loss or damage for items shipped back to City Optics until we have confirmed receipt of the goods.

6.5.6 Right to Reject Orders: City Optics reserves the right to refuse future orders from customers who have previously made unsubstantiated claims regarding the non-delivery of goods.

6.5.7 Claims Verification: In the event of a claim that an order was delivered without the product(s), we will conduct thorough verification procedures to ensure security, and compliance, and to prevent discrepancies.

6.5.8 Warranty Replacements and Repairs: Replacements and repairs under warranty are contingent on the assessment of manufacturing faults. The maximum repair warranty period extends 3 months from the date of repair completion.

6.5.9 Customer Acceptance of Responsibility: Upon delivery or pickup of the product, the customer assumes full responsibility for the items.

7.1. Privacy Protection: We are committed to protecting your privacy and personal information. Our Privacy Policy outlines how we collect, use, disclose, and protect your personal information. By using our products or services, you agree to our Privacy Policy.

  1. General Provisions

8.1. Governing Law: These Terms and any disputes arising out of or related to them are governed by the laws of the State of New South Wales, Australia.

8.2. Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.

8.3. Changes to Terms: We reserve the right to update or modify these Terms at any time without prior notice. Any changes will be effective immediately upon posting on our website or other communication channels.

  1. Price Match Guarantee

9.1 Carrera Sunglasses:

City Optics offers a Price Match Guarantee on all Carrera sunglasses. If you find a lower price on an identical pair of Carrera sunglasses advertised by another retailer in Australia, we will match the price under the following conditions:

  • Verification: The lower price must be verifiable by City Optics staff, and the product must be in stock and available for purchase at the lower price from the competing retailer at the time of the price match request.
  • Exclusions: The Price Match Guarantee does not apply to prices from online auction sites, clearance sales, liquidation sales, or prices that are part of a special promotion or discount offered by the other retailer.
  • Process: To request a price match, please provide proof of the lower price (e.g., advertisement, quotation) to City Optics staff either in-store or via email for online purchases.

9.2 Conditions:

  • The Price Match Guarantee applies only to prices for identical products (brand, model, and colour) and must include all costs associated with the item, including shipping and handling fees, if applicable.
  • The guarantee is valid at the time of purchase or within a specified period after purchase, as determined by City Optics.

10.1. September SMS Voucher Offer:

City Optics offers a $50 voucher to customers who present the SMS message received during the September promotion period. This voucher can be redeemed under the following conditions:

  1. Minimum Spend Requirement: The voucher is applicable on a minimum spend of $250. For example, if your total purchase is $250, you will receive a $50 discount, reducing the amount payable to $200.

  2. Validity: The voucher is valid for in-store purchases only and must be presented at the time of payment. The offer cannot be combined with any other discounts, promotions, or offers.

  3. Non-Transferable and No Cash Value: The voucher is non-transferable, cannot be redeemed for cash, and must be used in a single transaction. No change will be provided for any unused portion of the voucher.

  4. Exclusions: The offer excludes gift cards, vouchers, and any products or services already discounted.

  5. Expiration: The voucher is valid for use during the September promotion period only, and any unused vouchers will expire thereafter.

  6. Refer a Friend Offer: Customers who refer a friend to City Optics Penrith will receive an additional $25 off their next purchase. The referred friend must present the SMS message to receive the original $50 off offer. The referrer discount is valid for use in a single transaction and must meet the same terms and conditions as the original voucher, including the minimum spend of $250.

    By purchasing products or using services from us, you acknowledge that you have read, understood, and agree to be bound by these Terms and any updates or modifications thereto.
